General terms and conditions of the contract

1.- IDENTIFICATION OF THE PARTIES

On one side, KRONOTEX SPAIN SL (HOTEL MONTSIÀ AMPOSTA) NIF B98390461 with address at Barrio Castañares, s/n (09199) Burgos (hereinafter “the Hotel”).

On the other side, the client whose data appears in the reservation form.

The Client declares to be of legal age and have sufficient legal capacity to enter into contracts acting on their behalf.

2.- OBJECT

This document aims to inform you about the general conditions applicable to the processing of reservations through the website https://www.hotelmontsia.es/

On the Website you will find information about the services offered by the hotel, room availability, and the rates applicable at any given time.

Processing a reservation implies full acceptance without conditions of the legal notice, privacy policy, and these general conditions in their latest version. Therefore, we recommend that you read these conditions before formalizing your reservation.

These General Conditions can only be modified by the legal representation of the Company. Any modification will always be in writing and may not be altered by any person who does not hold the status of legal representative of the Company.

These General Conditions may be supplemented with Specific Conditions that may arise. In case of discrepancy between the specific and general conditions, the general conditions will prevail.

3.- CLIENT’S STATEMENTS

The Client states that the data provided when making the reservation are true, complete, and concise.

They confirm the requested reservation, especially the indicated dates, number of rooms, persons, accommodation, and chosen regime.

4. ACCESS TO THE WEBSITE

Access to this website is the responsibility of the user and is subject to the portal’s usage rules described in the legal notice

5. HIRING OF PRODUCTS AND SERVICES THROUGH THE WEBSITE:

5.1. Before making a reservation on our website, you will be informed of the services and specific conditions of the current offer.

5.2. The present general and specific conditions must be accepted by you before formalizing the reservation. The contract can be formalized in any of the languages available on the Website.

6. THE RESERVATION FORMALIZATION PROCESS ON THE WEBSITE CONSISTS OF 4 STEPS:

  • Availability: Search for dates, number of persons, and rooms.
  • Choice of regime and type of room, rate.
  • Summary of the reservation, collection of client data and, if applicable, payment via virtual POS.
  • Confirmation of the reservation.
  • Once the reservation is made, the emails and logs generated by the operation will be filed. The client will receive the details of their reservation by email, along with a number that will identify it (locator).

7. PRICE AND PAYMENT:

7.1. The conditions, price, and payment of the projected stay are expressly determined in the rate conditions included on the page where you make the reservation.

7.2. Promotions and offers will only be valid as long as they are accessible to the service recipients.

7.3. The prices indicated on the hotel’s Website are Public Sale Prices and include VAT. The transaction will be in EUROS, regardless of the client’s origin.

The price and conditions offered on our website may vary at any time, even if you request the same dates.

8. CANCELLATIONS/MODIFICATIONS OF RESERVATIONS AND NON-PRESENTATION:

8.1. They will be those specified in the selected offer.

8.2. All charges will be made on the credit card provided in your reservation. You expressly consent to these charges to cover possible penalties for cancellations or non-attendance.

9.- PLACE OF THE CONTRACT CELEBRATION AND DURATION

The contract is deemed to be concluded at the company’s registered office and will have the duration specified in the reservation.

12. NOTIFICATIONS

All notifications, requirements, requests, and other communications to be made by the parties in relation to these general conditions must be made via email or through the contact form available on the website.

13. ACCEPTANCE

The request and formalization of the reservation necessarily imply that each and every one of these general conditions, considered an integral part of the reservation and supplemented with the rate conditions and the applicable specific legislation, are expressly accepted by you.

14. APPLICABLE LAW AND JURISDICTION

This contract will be governed by Spanish law, and, for illustrative purposes but not limited to, these general conditions are subject to the provisions of Law 7/1998, of April 13, on General Contracting Conditions, Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, as well as all applicable tourism regulations and, subsidiarily, the Civil Code and the Commercial Code.

For any dispute that may arise regarding its validity, execution, compliance, or resolution, in whole or in part, the parties, with express waiver of their own jurisdiction if they have it, expressly submit to the jurisdiction and competence of the Courts and Tribunals of Amposta.
